Japanese government steps into the Glendale lawsuit over the "Girl Statue"


Japanese government filed an amicus brief in the United States Supreme Court, in support of the plaintiffs of the 2014 lawsuit who sued the City of Glendale to demand removal of the 'Comfort Women' Monument in Glendale's Central Park.


The initial Federal lawsuit filed by the plaintiffs, Koichi Mera and GAHT-US, had been dismissed at the District Court and the 9th Circuit Court of California in 2015 and 2016. In January 2017, the plaintiffs filed a petition for Writ of Certiorari in the US Supreme Court.


The plaintiffs also filed a separate State case with the same goal in California, only to be defeated at the Superior Court as well as the Appellate Court of California.


In addition to the Japanese government, two right-wing groups of Japan (The Society for Dissemination of Historical Fact and Nippon Today's Researchers Society (Kingen)) also filed a joint amicus brief in support of the plaintiffs.


The arguments contained in these briefs are quite weak and repetition of their previous claims. Following are some of the ciritical errors Japanese government made.


1. The "Girl Statue" in Glendale represents hundreds of thousands of victims of Japan's 14 years of military sexual slavery from a dozen countries, not just S. Korea. Japan's claim that the "Girl Statue" in Glendale represents the issue of "Comfort Women" between Japan and the Republic of Korea is a gross mischaracterization and intentional downplay of the historical facts.


2. Japanese government's claim that the "Announcement by Foreign Ministers of Japan and the Republic of Korea at the Joint Press Occasion (Dec. 28, 2015)" resolved the Japan's war crime of military sexual slavery in "final and irreversible" manner is a shameless and pathetic attempt to evade its state accountability for the largest case of government-led sex trafficking in modern history. This backdoor deal between Japan and S. Korea was severely condemned by the victims in and ouside of Korea, and vast majority of Korean people think the deal must be canceled.


3. The federal and local governments in the United States have a long history of commemorating the victims of human rights violations to remember and educate the public, regardless of the fact whether or not the perpetrator government accepted the responsibility. Germany, for the Holocaust, and the United States, for the Japanese Internment during WWII, are the good examples of those who accepted the responsibility. Japan, on the other hand, is still trying to skew the history and deny the responsibility.


4. In the brief, Japanese government uses the remarks by Mr. Shinsuke Sugiyama, its Deputy Minister for Foreign Affairs, at the Question and Answer Session, Convention on the Elimination of All Forms of Discrimination Against Women of UN (Feb. 16, 2016) to highlight its official position of denial that the victims were not sex slaves.


What is missing in this argument is the scathing criticism it received from the CEDAW (Mar. 7, 2016) in the concluding observation that recommended anything but the removal of a memorial to the victims.


29. The Committee reiterates its previous recommendations and observes that the issue of "comfort women" gives rise to serious violations that have a continuing effect on the rights of victims/survivors of those violations that were perpetrated by the State party's military during the Second World War given the continued lack of effective remedies for these victims. The Committee, therefore, considers that it is not precluded ratione temporis from addressing such violations, and urges the State party to:


(a) Ensure that its leaders and public officials desist from making disparaging statements regarding responsibility, which have the effect of re-traumatising victims;


(b) Recognize the rights of the victims to a remedy, and accordingly provide full and effective redress and reparation, including compensation, satisfaction, official apologies and rehabilitative services;


(c) Ensure that in the implementation of the bilateral agreement announced jointly with the Republic of Korea in December 2015, the State party takes due account of the views of the victims/survivors and ensure their rights to truth, justice, and reparations;


(d) Adequately integrate the issue of "comfort Women" in textbooks and ensure that historical facts are objectively presented to students and the public at large; and


(e) Provide information in its next periodic report on the extent of consultations and other measures taken to ensure the rights of victims/survivors to truth, justice and reparations.
