The US has dismissed North Korea¡¯s accusation that President Donald Trump has declared war against the country, calling it ¡®absurd¡¯ [Reuters] ¹Ì±¹Àº µµ³Îµå Æ®·³ÇÁ ´ëÅë·ÉÀÌ ºÏÇÑÀ» »ó´ë·Î ÀüÀïÀ» ¼±Æ÷Çß´Ù´Â ºÏÇÑÃøÀÇ ºñ³­À» ¡®¾óÅä´çÅä ¾Ê´Ù¡¯¸ç ÀÏÃàÇß´Ù.

 

In the coming days, there are three possible triggers for war with North Korea that need to be carefully watched. ºÏÇÑ°úÀÇ ÀüÀïÀ» À¯¹ß½Ãų ¼¼ °¡Áö µµÈ­¼±ÀÌ ÀÖÀ¸¸ç À̵éÀ» ¾ÕÀ¸·Î ½ÅÁßÇÏ°Ô »ìÆì¾ß ÇÑ´Ù.

 

The first possible trigger is a declaration of war by North Korea, especially since the United States has made clear it has not declared war. The idea that countries would formally declare war against each other, before commencing hostilities, is a relic of the early 20th century. ù¹ø° ½ÅÈ£´Â ºÏÇÑ ÃøÀÌ ÀüÀïÀ» ¼±Æ÷ÇÏ´Â °ÍÀÌ´Ù. ¹Ì±¹Àº ÀüÀïÀ» ¼±Æ÷ÇÑ ÀûÀÌ ¾ø´Ù°í ºÐ¸íÈ÷ ¹àÈù ¹Ù ÀÖ´Ù. ±¹°¡µéÀÌ Àû´ëÇàÀ§¸¦ ½ÃÀÛÇϱ⿡ ¾Õ¼­ ¼­·Î¸¦ ÇâÇØ °ø½ÄÀûÀ¸·Î ÀüÀïÀ» ¼±Æ÷ÇÑ´Ù´Â ¹ß»óÀº 20¼¼±â ÃÊÀÇ À¯¹°ÀÌ´Ù.

After the second world war, the United Nations hoped that all members would refrain from the threat or use of force against the territorial integrity or political independence of any state, to which Declarations of War by individual states would become redundant. However, when the North Korean armed forces advanced over the 38th parallel on June 25, 1950, without a declaration of war, it was shown how in vain this hope was. 2Â÷ ¼¼°è´ëÀü ÀÌÈÄ À¯¿£Àº ±¹°¡°¡ °³º°·Î ÀüÀïÀ» ¼±Æ÷ÇÏ´Â ÀÏÀÌ ¹«¿ëÁö¹°ÀÌ µÇµµ·Ï, ȸ¿ø±¹ ¸ðµÎ°¡ ¾î´À ±¹°¡ÀÇ ¿µÅä º¸ÀüÀ̳ª Á¤Ä¡Àû µ¶¸³À» À§ÇùÇÏ¸ç ±º»ç·ÂÀ¸·Î À§ÇùÀ» °¡Çϰųª ±º»ç·ÂÀ» »ç¿ëÇÏ´Â ÀÏÀ» »ï°¡±æ ¿øÇß´Ù. ±×·¯³ª ºÏÇÑÀÇ ±º´ë°¡ ÀüÀïÀ» ¼±Æ÷ÇÏÁö ¾ÊÀº »óÅ¿¡¼­ 1950³â 6¿ù25ÀÏ, 38¼±À» ³Ñ¾î °ø°ÝÇÏÀÚ À¯¿£ÀÇ ¹Ù¶÷Àº ÇêµÈ ¹Ù¶÷ÀÌ µÇ°í ¸»¾Ò´Ù.

 

The response to this act of aggression by North Korea was the 84th resolution (pdf) of the Security Council (when the Soviet Union was absent from the vote) to defend South Korea under the UN flag but with the leadership of the US. ºÏÇÑÀÇ ÀÌ·¯ÇÑ µµ¹ß ÇàÀ§¿¡ ´ëÇÑ ´ëÀÀÀ¸·Î À¯¿£ÀÇ ±ê¹ß ÇÏ¿¡, ±×·¯³ª ¹Ì±¹ÀÇ ÁöÈÖ¸¦ ¹ÞÀ¸¸ç ³²ÇÑÀ» ÁöŲ´Ù´Â ¾Èº¸¸®ÀÇ °áÀǹ® Á¦84È£(´ç½Ã ¼Ò·ÃÀº ÅõÇ¥¿¡ ºÒÂüÇß´Ù.)°¡ äÅõǾú´Ù.

 

Today, the situation is even more complicated as the North Korean rhetoric of declaring war is not uncommon. Following the 2013 sanctions (pdf) approved by the Security Council against North Korea for their nuclear test, Kim Jong-un promised a pre-emptive strike against the US with nuclear weapons. ¿À´Ã³¯¿¡´Â ÀüÀïÀ» ¼±Æ÷ÇÑ´Ù´Â ºÏÇÑÀÇ À§ÇùÀÌ µå¹°Áö ¾Ê°Ô µîÀåÇÔ¿¡ µû¶ó »óȲÀº ´õ´õ¿í º¹ÀâÇØÁ³´Ù. ºÏÇÑÀÇ ÇÙ½ÇÇè¿¡ ¹Ý´ëÇØ ¾Èº¸¸®¿¡¼­ ½ÂÀÎÇÑ 2013³â ´ëºÏ Á¦Àç ÀÌÈÄ ±èÁ¤ÀºÀº ÇÙ¹«±â¸¦ ÀÌ¿ëÇØ ¹Ì±¹À» ¼±Á¦°ø°ÝÇÏ°Ú´Ù°í ¼±¾ðÇß´Ù.

 

This was followed by a ¡°Full War Declaration Statement¡±. This was all part of their assertions that North Korea had scrapped the armistice that ended the first Korean War in 1953. ±×·± ´ÙÀ½ ¡°Àü¸éÀü ¼±Æ÷¡±°¡ ÀÖ¾ú´Ù. ÀÌ ¸ðµÎ´Â 1953³â Çѱ¹ ÀüÀïÀ» Á¾½Ä½ÃŲ ÈÞÀüÇùÁ¤À» ºÏÇÑÀº ÀÌ¹Ì Æó±âÇß´Ù´Â ÁÖÀåÀÇ ¿¬Àå¼±¿¡ ÀÖ´Ù.

 

To show their determination in 2013, North Korea also cut the hotline that enabled direct communication between North and South Korea. Although the hotline was reconnected a few months later, when South Korea closed down the joint Kaesong industrial complex following Kim Jung-un¡¯s fourth nuclear test in early 2016, North Korea condemned the act as a Declaration of War, and then cut the hotline again. ºÏÇÑÀº 2013³â¿¡ ½º½º·ÎÀÇ È®°íÇÔÀ» º¸¿©ÁÖ±â À§Çؼ­ ³²ºÏ°£ Á÷Á¢ ÅëÈ­¸¦ °¡´ÉÇÏ°Ô Çß´ø ÇÖ¶óÀÎÀ» ²÷¾ú´Ù. ÀÌ ÇÖ¶óÀÎÀº ¸î°³¿ù ÈÄ¿¡ ´Ù½Ã ¿¬°áµÇ±ä ÇßÁö¸¸, 2016³â ÃÊ ±èÁ¤ÀºÀÇ ³×¹ø° ÇÙ½ÇÇè ÈÄ¿¡ ³²ÇÑÀÌ °³¼º°ø´ÜÀ» Æó¼âÇÏÀÚ ºÏÀº ÀÌ Á¶Ä¡¸¦ ¼±ÀüÆ÷°í¶ó°í ºñ³­Çϸç ÇÖ¶óÀÎÀ» ´Ù½Ã ²÷¾ú´Ù.

 

Cutting the hotline is more dangerous than the rhetoric. Hotlines prevent accidental war. South Korea, which has a hotline to China, has been trying to have its hotline to North Korea reconnected. However, the line that is really needed is one between North Korea and Washington. Such best practice has been evident since 1963, following the Cuban Missile Crisis, when the two superpowers recognised the necessity to be able to talk directly, at short notice, whenever required so as not to stumble into nuclear war. ÇÖ¶óÀÎÀ» ²÷´Â´Ù´Â °ÍÀº ¸»½Î¿òº¸´Ù ´õ¿í À§ÇèÇÏ´Ù. ÇÖ¶óÀÎÀº ½Ç¼ö·Î ÀüÀïÀÌ ÀϾ´Â °ÍÀ» ¹æÁöÇÑ´Ù. Possible detonation of a nuclear device ÇÙÆøźÀÇ Æø¹ß °¡´É¼º

 

The second possible trigger to watch for is the North Korea threat of a possible detonation of a nuclear device in the atmosphere over the Pacific. Although the aesthetics of such an act would shock the world as humanity has not seen a nuclear airburst since that done by China in 1980, this would not be the beginning of hostilities. Such an act would violate international environmental law, not the laws of war and peace.
