Statement Regarding Harvard Law School Mitsubishi Professor John Mark Ramseyer¡¯s Scholarship on Japanese Military ¡°COMFORT WOMEN¡±
[Washington DC. Maryland, Virginia] - Harvard Law School Mitsubishi Professor of Japanese Legal Studies, John Mark Ramseyer¡¯s recent publication ¡°Contracting for Sex in the Pacific War¡± in The International Review of Law and Economics (Dec. 2020) sparked global controversy and anger by conflating Japanese military ¡°comfort women¡± with paid, free-will, contracted prostitution, thus denying state-sanctioned sexual enslavement. This article disregards testimonies by survivors from more than ten countries across the Asia-Pacific region, extensive research and investigation by activists and scholars over the past three decades, and reports and recommendations by international organizations such as the United Nations, International Commission of Jurists (first appeared in 1994), Amnesty International, and International Labour Organization. The article also reflects arguments made by the Japanese right-wing government that denies historical facts and evades any responsibility for the grave human rights violations and crimes perpetrated during the Asia-Pacific War.
Washington Coalition for Comfort Women Issues (WCCW) and Washington Butterflies for Hope are appalled by Professor Ramseyer¡¯s misuse, distortions, and willful misrepresentation of ¡°comfort women¡± histories as established - by global scholarship and multiple victims¡¯ oral testimonies. Research integrity and principles should be maintained through a thorough review of existing scholarship, but he apparently did not see the extensive bibliographies and primary resources recommended by ¡°comfort women¡± scholars to be found in various academic institutions and other organizations such as Asia Policy Point or WCCW. Existing scholarship initiated by the seminal work of Japanese historian Professor Yoshimi Yoshiaki at Chuo University in 1995 revealed records of the Japanese military¡¯s supervision of private recruiters and its direct involvement in the coercion of women (Sexual Slavery in Japanese Military During World War¥±, Columbia University Press). Unfortunately, Prof. Ramseyer relied solely on Japanese scholars and his motivation is suspicious because he subsequently published a media piece ¡°Recovering the Truth about the Comfort Women¡± in the online journal Japan Forward (January 2021) to repeat his earlier argument with a politically charged tone, claiming that the ¡°comfort women¡± history is ¡°pure fiction.¡± Japan Forward is the site established by the neo-nationalist Japanese Sanki Media group to propagate their denialism.
Professor Ramseyer¡¯s fallacy is not limited to his biased references but also omission of a significant part of the larger picture. He focuses only on Korean ¡°comfort women¡± without mentioning other victims from more than ten other Asian countries; he mentions only ¡°women¡± but neglects to include young girls in their early teens – many even before their menstruation started. Sex with underage girls was not a contractual agreement but rape -a crime. There were many ways to bring them to ¡°comfort stations¡± such as by kidnapping, deceptive hiring, and coercion, but he mentions only the recruitment method of private entrepreneurs without providing any reliable evidence. The involvement of the Japanese military in child sex-trafficking – of underage girls and even boys - was widely proven by other scholars. In short, Professor Ramseyer¡¯s work lacks academic integrity, research ethics, and above all, respect for the remaining survivors-turned-activists now in their 90¡¯s.
Grassroots activism on ¡°comfort women¡± issues in the United States supported the passage of House Resolution 121 in 2007 and the U.S. House of Representatives called on the Japanese government to ¡°formally acknowledge, apologize, and accept historical responsibility in a clear and unequivocal manner for its Imperial Armed Forces¡¯ coercion of young women into sexual slavery.¡± The passage of this Resolution which ascribed responsibility to Japan at the governmental level, is yet another fact that Professor Ramseyer omits.
We strongly demand that Professor Ramseyer immediately and voluntarily withdraw his article and apologize sincerely to the last few remaining victims of the ¡°comfort stations¡± who are, by all accounts, victims of the crime of international sex trafficking.
Ramseyer¡¯s violent argument not only perpetuates the egregious, brutal violence committed against these women and girls but also colludes with and validates Japan¡¯s denial and deliberate erasure of this violent and unrepentant chapter in its history. Any form of violation and exploitation of women¡¯s bodies should not, and will not, be tolerated, whether in the past or in the present, either by word or deed.
We are committed to doing whatever is necessary to respect, support, and protect these women¡¯s dignities and their right to continue their ongoing fight for justice.
